2,970 PointsOld Web Designer will not turn over work. (Need Help)
I'm trying to get my new client website to make changes to but the old web design company (Most likely just one or two person group) will not give up any of the files and the logo. They said that they own the rights to the logo and the website which I have never heard of before.
Every website I've made was never a copyrighted issue of I own the rights of the design. It's not a money issue in the part that the client did pay over $9000 in 2011 for the site and they wanted $3500 to make text changes and add a new page to the site. The site is not a CMS that I can tell but it is using some php. I have to wait until Monday for the client to send me the contract of the other web designer made him sign.
If the old web designer will not give up the logo in a AI or PDF and the website, what are the options?

8,625 Pointsfrom what i know dealing with host companies you have call the host company and prove that you own the company and they need to transfer the files or else. However, it might be an ugly battle I did it one time it took few month. I got the domain to transfer somehow i lost all the files.

15,710 PointsI would not just rip it with http://www.httrack.com/ and have your own copy of the site.
A place I worked at forgot to pay for a few clients istock images and got a hefty fine into the 1000's.
When a photographer takes pictures they should tell you what rights you have e.g. you can use them on your site but if you want them to be used in your catalog it's extra.
It's all about the contract.

8,625 Pointsmay be they got him with the contract if there is one. May be ask for the contract.However I doubt they have any rights unless they can prove it.

12,216 PointsTechnically they are correct. As you may or may not know, the second a work is created by someone they own the copyright. The exception to this rule is work-for-hire. However, unless your client specifically put into the contract that all the work done for them would be considered work-for-hire it's going to be tough to make that claim. Unfortunately, while this is shady on the part of the previous developer, they are well within their rights to deny you.
At least this is my understanding of copyright law (which I've done a decent amount of research into). Someone please correct me if this isn't true.
