The variable you pass into the anonymous function in "fail" isn't the same as the one you use in the function. Change it from jqHR to jqXHR.

Completed it looks like:

$.get("missing.html", function(data) {
  $("#footer").html(data);
}).fail(function(jqXHR) {
  alert(jqXHR.statusText);
});
