Task1 is no longer correct. Please Help!

(Task 1) create a navigation element with an unordered list element affter the link inside the header. Don't add any list items or links just yet.

(Task 2) Inside the nav element, create three list items with the words, "Portfolio","About", and "Contact". Don't add links yet.

I don't see anything wrong. task 1 is fine then when i go to task 2 it says task 1 no longer correct.

  </head>

      <a href="index.html">
        <nav>
          <ul>
            <li>Portfolio</li>
            <li>About</li>
            <li>Contact</li>
          </ul>
        </nav>
        <h1>Nick Pettit</h1>

It seems that it shouldn't have validated the first stage in the first place. Your nav list is encapsulated in the <a> element. The instructions indicate to place the <nav> element after the link.

INSTRUCTIONS "Create a navigation element with an unordered list element after the link inside the header. Don’t add any list items or links just yet."

See code below.

<!DOCTYPE html>
<html>
  <head>
    <meta charset="utf-8">
    <title>Nick Pettit</title>
  </head>
  <body>
    <header>
      <a href="index.html">
        <h1>Nick Pettit</h1>
        <h2>Designer</h2>
      </a>
<!-- Notice how the nav comes after the closing <a> tag-->
      <nav>
        <ul>
          <li>Portfolio</li>
          <li>About</li>
          <li>Contact</li>
        </ul>
      </nav>
    </header>
    <section></section>
    <footer>
      <p>&copy; 2013 Nick Pettit.</p>
    </footer>
  </body>
</html>
